PLEASE READ THESE TERMS CAREFULLY BEFORE USING HUMRAH
These Terms constitute a legally binding agreement between you and Humrah under the Indian Contract Act, 1872. By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your access to and use of the Humrah mobile application and related services (collectively, the "Service"), operated by Humrah ("Humrah", "we", "us", or "our"), a company registered in India with its principal place of operations in Delhi.
By creating an account, accessing, or using the Service, you ("User" or "you") enter into a legally binding contract with Humrah under the Indian Contract Act, 1872. You represent that you have read and understood these Terms and have the legal capacity to accept them.
By using Humrah, you agree to:
- Be bound by these Terms of Service in their entirety.
- Comply with Humrah's Privacy Policy, which is incorporated into these Terms by reference.
- Follow Humrah's Community Guidelines as published and updated from time to time.
- Acknowledge and accept the risks associated with arranging and attending in-person meetups with other users, as described in Section 8.
If you do not agree to these Terms, you must not access or use the Service. Continued use of the Service following notification of any amendment to these Terms constitutes acceptance of those amendments, subject to Section 19.
Dispute Resolution Notice
These Terms include an agreement to resolve disputes through binding arbitration rather than court litigation, subject to the exceptions described in Section 17. Please read that section carefully before using the Service.
Electronic Agreement
You acknowledge that these Terms are entered into electronically, that your electronic acceptance constitutes a valid and binding agreement equivalent to a written signature under applicable Indian law, and that you have the ability to store and access these Terms for your own records.
3. Eligibility & Age Requirements
Age Requirement: You must be at least 18 years of age to create an account or use the Service. This requirement is mandatory and non-negotiable.
Eligibility Conditions
To create and maintain a Humrah account, you must at all times:
- Be at least 18 years of age.
- Have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872.
- Not be subject to any court order, legal restriction, or applicable law that prohibits you from using the Service or entering into agreements of this nature.
- Not have been previously permanently banned from the Humrah platform.
- Access the Service only from a location where the Service is lawfully available.
Age Declaration
During account registration, you are required to declare that you are 18 years of age or older. This is a self-declaration. Humrah does not use face verification technology as a means to assess or confirm a user's age. Face verification is used solely for duplicate account detection and fraud prevention. Humrah does not represent that any technical measure independently verifies or guarantees a user's age.
Consequences of Misrepresentation
If you provide false information about your age or eligibility:
- Your account will be immediately suspended or permanently terminated.
- All personal data associated with the account will be deleted in accordance with the Privacy Policy.
- You will be prevented from re-registering on the platform.
- Humrah may report the matter to competent law enforcement authorities where required or appropriate.
Humrah reserves the right to terminate any account where eligibility requirements are not or cease to be met, at any time.
4. Account Registration & Verification
Account Creation
To access the Service, you must create an account by providing accurate information, including:
- Valid Email Address: Required for OTP-based authentication and account communications.
- Profile Information: Name, declared age, gender, bio, and interests.
- Profile Photos: At least one clear, current photograph of yourself.
- Approximate Location: City-level location, used for user matching. See the Privacy Policy for details.
Mandatory Face Verification
All users must complete a face verification process before accessing core features of the Service. Face verification is a security mechanism designed to reduce fraudulent and duplicate account creation. Before biometric data is collected, you will be presented with a separate consent screen that explains the purpose, data type, retention period, and your rights. By proceeding with face verification, you provide explicit consent to that processing.
Important limitations of face verification:
- Face verification confirms that a video was recorded by a real, live person and checks whether the same face is associated with an existing account. It does not verify identity documents, legal name, age, or any other attribute.
- Face verification reduces the risk of duplicate or re-registered banned accounts but does not eliminate it entirely.
- Humrah does not represent that face verification guarantees the accuracy of any user's profile or their suitability for interaction.
- The original verification video is deleted within 48 hours of processing. Face embeddings (mathematical representations of facial geometry) are retained as described in the Privacy Policy and cannot be used to reconstruct a photograph.
Verification Appeal
If your account registration is declined or suspended as a result of an automated face verification outcome, you may appeal that decision. To do so, contact the Grievance Officer at grievance@humrah.in with the subject line "Verification Appeal". A manual review will be conducted and a response provided within 15 business days.
Account Accuracy
You agree to:
- Provide accurate, current, and complete information at registration and maintain its accuracy throughout the life of the account.
- Use your real name and upload photographs that represent your current appearance.
- Not impersonate any other person or entity.
- Not create an account on behalf of any third party without their explicit authority.
One Account Per Person: Each individual may hold only one active Humrah account. You may not share your account with another person. Creating multiple accounts is a violation of these Terms and will result in termination of all associated accounts.
5. Service Description
What Humrah Provides
Humrah is a technology platform that enables registered users to discover other users in their area, communicate through in-app messaging, and arrange voluntary in-person meetups at public locations for the purpose of social companionship. The Service includes:
- User Matching: Connecting users with others in a similar geographic area based on location and stated interests.
- In-App Messaging: A communication channel between matched users within the platform environment.
- Booking System: A feature enabling users to propose, agree upon, and record meetup arrangements at public locations.
- Safety Features: Tools to report conduct, block other users, and submit complaints for moderation review.
- Verification System: Face verification as described in Section 4, intended to reduce fraudulent or duplicate accounts.
What Humrah Is Not
The Service is explicitly not:
- A dating, romantic matchmaking, or relationship service.
- An escort, adult entertainment, or sexual services platform.
- A professional networking, recruitment, or business service.
- A background screening, criminal record check, or identity verification service in any legal or regulatory sense.
- A guarantee of safety, compatibility, positive experience, or any particular outcome from a meetup.
Service Availability
Humrah does not guarantee that the Service will be available at all times. Access may be suspended for maintenance, upgrades, or circumstances beyond Humrah's reasonable control. Humrah is not liable for losses arising from service unavailability, except to the extent required by applicable law.
6. Nature of Bookings & Facilitation
The Humrah booking system provides a structured way for users to propose and confirm meetup arrangements with each other. It is important that users understand the nature and limitations of this feature.
Peer-to-Peer Arrangements
All bookings are peer-to-peer arrangements made directly between users. When a booking is confirmed through the platform:
- The arrangement is between the two users involved, not between either user and Humrah.
- Humrah is not a party to the arrangement and assumes no obligations in connection with it.
- Humrah acts solely as a technology facilitator enabling users to communicate and coordinate. Humrah is not an agent of either user in connection with any booking.
- No employment, partnership, or agency relationship is created between Humrah and any user by reason of a booking being confirmed on the platform.
No Guarantee of Performance
Humrah does not guarantee that any user will attend a confirmed meetup, conduct themselves appropriately, or fulfil any expectation communicated through the platform. Users are solely responsible for assessing whether to proceed with any meetup arrangement and for taking appropriate precautions.
Payments
Where any payment functionality is made available through the platform (whether currently or in future), such functionality is provided solely as a convenience tool. Humrah does not act as a financial intermediary, payment processor in a regulatory sense, or party to any financial transaction between users. All payment disputes between users are the responsibility of the users themselves. Humrah's involvement in any payment flow will be described separately in supplemental terms when such functionality is activated.
7. User Conduct & Responsibilities
General Standards
As a user of the Service, you agree to:
- Conduct yourself with respect and courtesy toward all other users at all times, both on the platform and during offline interactions.
- Communicate honestly and accurately through the platform.
- Attend meetups you have confirmed or provide timely notice of cancellation through the application.
- Respect the stated preferences, boundaries, and consent of other users at all times.
- Comply with all applicable laws and regulations during any meetup or interaction arising from use of the Service.
- Report suspected violations of these Terms, Community Guidelines, or applicable law using the in-app reporting tools.
- Use the Service only for its stated purpose of facilitating lawful social companionship.
Meetup Conduct
For in-person meetups specifically:
- Meetups must take place only in public, well-populated locations accessible to third parties.
- Users must not pressure or coerce another user to move to a private location.
- Users must respect the agreed scope, duration, and nature of the meetup as communicated through the platform.
- Users must provide honest post-meetup feedback and ratings through the platform where invited to do so.
User Responsibility for Own Safety
Each user is solely responsible for exercising their own judgment about whether to proceed with any meetup, and for taking appropriate safety precautions before, during, and after any offline interaction. Humrah's safety recommendations in Section 8 are provided for informational purposes and do not constitute a guarantee of safety or shift responsibility from the user to Humrah.
8. Offline Meetings: Risk, Safety & Disclaimer
Notice: Humrah is a communication and facilitation platform. Humrah does not organise, supervise, attend, or guarantee any offline meeting between users. All offline interactions are voluntary and are undertaken by users at their own risk and on their own initiative.
Assumption of Risk
By using the Service and choosing to meet with other users in person, you expressly acknowledge and accept the following:
- Humrah does not conduct criminal background checks, law enforcement record checks, or any other form of character screening on users.
- Humrah does not verify a user's employment, education, professional credentials, marital status, or any personal attribute beyond the limited face verification described in Section 4.
- Profile information displayed on the platform is provided entirely by the user themselves and may be incomplete, inaccurate, or false. Humrah does not independently verify the accuracy of user-provided profile content.
- Another user may misrepresent their identity, intentions, or personal circumstances, and Humrah cannot prevent or guarantee against this.
- In-person interactions with strangers carry inherent and unavoidable risks, including but not limited to physical harm, emotional distress, or property loss. These risks are assumed entirely by the user.
- Humrah cannot predict, control, or be responsible for the behavior of any user during an offline meeting.
No Duty of Care for Offline Interactions
Humrah's duty of care to users extends to the operation of the platform itself — including the availability, accuracy, and security of platform functions. Humrah does not owe a duty of care in relation to the conduct, safety, or outcome of offline meetings arranged through the platform. Users who proceed with an offline meeting do so based on their own independent judgment.
Safety Recommendations
Humrah provides the following recommendations for user safety. These are informational suggestions only and are not representations that following them will guarantee safety:
- Inform a trusted person of the meetup details — time, location, and the identity of the person you are meeting — before you attend.
- Use your device's location-sharing feature to allow a trusted contact to monitor your location during the meetup.
- Meet only in well-lit, populated public places and do not agree to move to a private location.
- Trust your own judgment: leave immediately if you feel uncomfortable, unsafe, or if the situation changes in a way that concerns you.
- Avoid consuming excessive alcohol or substances that may impair your judgment during a meetup with someone you do not know well.
Reporting Safety Concerns
Users may report safety concerns, misconduct, or emergency situations involving another user through the in-app reporting tools available on any user profile or booking page. In the event of immediate danger, users must contact the relevant emergency services (such as the police) directly and not rely on Humrah as an emergency response mechanism. Humrah's moderation team will review reported conduct and take appropriate platform-level action, which may include account suspension, permanent ban, or referral to law enforcement where required.
9. Prohibited Activities & Enforcement Powers
Prohibited Conduct
The following conduct is strictly prohibited on or in connection with the Service. Violations may result in immediate account suspension, permanent termination, content removal, and referral to law enforcement where applicable.
Sexual and Adult Services
- Offering, soliciting, or arranging sexual services, escort services, or any form of prostitution through the platform.
- Using the platform to arrange sexual or intimate encounters.
- Sending unsolicited sexual content, messages, or images to other users.
Illegal Activities
- Using the Service to facilitate, plan, or conduct any illegal activity under Indian law or the law of the user's location.
- Drug dealing, trafficking in controlled substances, or encouraging substance abuse.
- Human trafficking, exploitation, coercion, or any form of modern slavery.
- Fraud, impersonation, financial scams, or money laundering through or using the platform.
- Threatening, intimidating, or committing or facilitating violence against any person.
Platform Abuse
- Creating more than one account, or re-registering after a permanent ban.
- Impersonating any other person, business, or entity.
- Using automated bots, scripts, or other non-human processes to access or interact with the Service.
- Scraping, harvesting, or systematically collecting data from other users or from the platform without authorisation.
- Reverse engineering, decompiling, or attempting to extract the source code or algorithms of the application.
- Uploading or distributing malware, viruses, or any code designed to disrupt, damage, or gain unauthorised access to the platform or user data.
- Attempting to circumvent or undermine any security, verification, or moderation feature of the platform.
Humrah's Enforcement Powers
In response to suspected or confirmed violations of these Terms or Community Guidelines, Humrah may, at its sole discretion and without prior notice where urgency or safety requires:
- Remove or hide any user-generated content that violates these Terms or applicable law.
- Issue a warning to the user responsible for the violation.
- Temporarily restrict the user's access to specific features or the Service as a whole pending investigation.
- Conduct an internal investigation, including review of account data, communications, and verification records, to the extent permitted by applicable law and the Privacy Policy.
- Permanently suspend or terminate the account.
- Preserve relevant account data, communications, and records for the purpose of cooperating with law enforcement or regulatory authorities.
- Report the conduct and share relevant information with competent law enforcement or regulatory authorities where required by law or where Humrah determines this is appropriate in the interest of user safety.
Humrah's exercise of any enforcement power does not constitute an admission that Humrah owes any duty of care in relation to the relevant conduct or that Humrah has assumed supervisory responsibility over users.
10. User-Generated Content
Definition
"User Content" means all information, photographs, messages, ratings, feedback, and other materials that you submit, upload, or transmit through the Service, including profile content and in-app communications.
Your Responsibility
You are solely responsible for all User Content you submit. By submitting User Content, you represent and warrant that:
- The content is accurate and not misleading.
- You own or have the necessary rights to submit the content and to grant Humrah the licence described below.
- The content does not violate any applicable law or infringe the intellectual property, privacy, or other rights of any third party.
Content Standards
User Content must not:
- Be false, deceptive, or materially misleading.
- Be sexually explicit, pornographic, or obscene.
- Promote, incite, or facilitate violence, discrimination, or hatred toward any person or group.
- Infringe any third party's intellectual property, privacy, or other legal rights.
- Constitute harassment, threats, or abuse directed at any other user.
- Violate any applicable Indian law or regulation.
Licence to Humrah
By submitting User Content to the Service, you grant Humrah a non-exclusive, worldwide, royalty-free, sublicensable licence to use, store, display, reproduce, and transmit that content solely for the purposes of operating, maintaining, and improving the Service. This licence does not extend to any use of your personal data beyond what is described in the Privacy Policy. You retain ownership of your User Content.
Content Removal
Humrah reserves the right to remove or restrict any User Content that, in Humrah's reasonable assessment, violates these Terms, applicable law, or poses a risk to user safety, without prior notice. Removal of content does not create any liability on Humrah's part in relation to that content.
11. Privacy & Data Protection
Humrah's collection and processing of personal data is governed by the Privacy Policy, which is incorporated into these Terms by reference. The Privacy Policy is available within the application and describes how Humrah collects, uses, stores, shares, and protects personal data, and the rights available to users under the Digital Personal Data Protection Act, 2023.
Key Points Relevant to These Terms
- Humrah processes personal data on the basis of explicit, informed consent obtained at registration. Certain categories of personal data — including biometric data in the form of face embeddings — are subject to a separate, dedicated consent step within the application before processing begins.
- Face embeddings are processed solely for duplicate account detection and fraud prevention. They are not used for age verification, advertising, or any other purpose. They cannot be converted back into a photograph and are not shared with other users.
- Approximate location data is used for user matching. Precise GPS location is optional and collected only with the user's explicit permission. Location data is not used for advertising or continuous background tracking.
- In-app messages are stored for 90 days from the date of the message. They may be reviewed by Humrah's moderation team in connection with a reported complaint or investigation, to the extent permitted by applicable law.
- Humrah does not sell personal data to third parties for marketing or commercial purposes.
Users are encouraged to read the Privacy Policy in full. In the event of any inconsistency between a provision of these Terms and a provision of the Privacy Policy on a data protection matter, the Privacy Policy will govern.
12. Intellectual Property
Humrah's Intellectual Property
All intellectual property rights in the Service — including the Humrah name, logo, trademarks, application design, user interface, source code, algorithms, graphics, and all original content created by Humrah — are owned by or licensed to Humrah. Nothing in these Terms transfers any intellectual property rights to you.
Limited Licence to Users
Subject to your compliance with these Terms, Humrah grants you a limited, personal, non-transferable, non-sublicensable, revocable licence to access and use the application on your personal device solely for the purpose of using the Service as described in these Terms. This licence does not include any right to:
- Copy, reproduce, modify, or distribute any part of the application or its content.
- Reverse engineer, decompile, disassemble, or attempt to extract source code from the application.
- Use Humrah's trademarks, trade names, or branding in any manner.
- Create derivative works based on the Service or any part of it.
- Sub-licence the application to any other person.
This licence is automatically revoked upon termination of your account or breach of these Terms.
13. Account Suspension & Termination
Termination by You
You may terminate your account at any time by using the account deletion function in the application (Settings → Account Settings → Delete Account) or by sending a written request to support@humrah.in. Account deletion will be processed in accordance with the timelines set out in the Privacy Policy. Termination does not affect any obligation or liability that arose prior to termination.
Suspension and Termination by Humrah
Humrah may suspend or permanently terminate your account in the following circumstances:
- Immediate suspension without prior notice where Humrah has reasonable grounds to believe that continued access poses a safety risk to any user, or where illegal conduct is suspected.
- Suspension pending investigation where a complaint or report about your conduct is under review by the moderation team.
- Permanent termination following a confirmed material violation of these Terms, including but not limited to the prohibited conduct described in Section 9.
- Termination with notice where Humrah decides to discontinue the Service or a material part of it, or where your account does not meet the eligibility requirements in Section 3.
Risk-Based Restrictions
In circumstances where immediate termination is not warranted but Humrah has safety or compliance concerns, Humrah may apply temporary restrictions to your account, including limiting your ability to initiate new conversations, create new bookings, or access certain features, while an investigation is conducted. Humrah is not required to disclose the specific parameters of any such restriction.
Evidence Preservation
Upon suspension or termination of an account for safety, legal, or compliance reasons, Humrah may preserve relevant account data, communications, and records for a period determined by the applicable legal obligation or Humrah's legitimate interest in cooperating with law enforcement. This preservation occurs independently of the standard data deletion timelines in the Privacy Policy and overrides them to the extent required by law.
Effects of Termination
Upon termination:
- Your access to the Service is immediately revoked.
- Your profile is removed from visibility on the platform.
- Your personal data will be deleted in accordance with the Privacy Policy, subject to any applicable legal hold.
- Your licence to use the application under Section 12 is automatically revoked.
- Provisions of these Terms that by their nature survive termination — including Sections 8, 9, 14, 15, 16, 17, and 18 — remain in full force.
14. Limitation of Liability
Please read this section carefully. It describes the limitations on Humrah's legal liability. These limitations apply to the maximum extent permitted by applicable Indian law. Nothing in this section excludes liability that cannot be excluded under applicable law.
Categories of Excluded Liability
To the maximum extent permitted by applicable Indian law, Humrah shall not be liable for:
- Any injury, harm, assault, theft, loss, or damage — whether physical, psychological, financial, or otherwise — that arises from or in connection with an offline meeting between users arranged through the platform. Users attend such meetings at their own risk and on their own account, as described in Section 8.
- The conduct, statements, representations, or behavior of any user, whether on the platform or offline.
- Any loss of profits, revenue, business opportunity, or anticipated savings.
- Any indirect, incidental, special, consequential, or punitive loss or damage.
- Any loss of data or corruption of data arising from use of the Service, beyond what is attributable to Humrah's negligence in operating the platform.
- Any interruption, suspension, or unavailability of the Service arising from circumstances beyond Humrah's reasonable control.
Proportional Liability Cap
Where Humrah is found liable for a claim arising from or in connection with the Service, and where such liability is not excluded under this section or applicable law, Humrah's total aggregate liability to you in respect of all such claims shall not exceed the greater of:
- The total amount, if any, actually paid by you to Humrah for the use of the Service in the twelve months immediately preceding the event giving rise to the claim; or
- ₹5,000 (five thousand Indian rupees).
This cap applies in aggregate to all claims, not per individual claim.
Statutory Rights Not Affected
Nothing in these Terms excludes or limits Humrah's liability for: (a) fraud or fraudulent misrepresentation; (b) death or personal injury caused by Humrah's negligence; or (c) any other liability that cannot be lawfully excluded or limited under applicable Indian law. Where applicable consumer protection law prohibits the exclusion of implied warranties or the limitation of liability for certain damages, the exclusions and limitations in this section apply only to the fullest extent permitted by such law.
15. Disclaimers
The Service is provided on an "as is" and "as available" basis. Humrah makes no representations or warranties, express or implied, beyond those that cannot be excluded under applicable Indian law.
No Warranty as to Service Quality
Humrah does not warrant that:
- The Service will be available at all times or free from interruption, error, or defect.
- Any defect or error in the Service will be corrected within any specific timeframe.
- The Service will meet your individual requirements or expectations.
- Data transmitted through or stored on the Service will be immune from unauthorised access, despite Humrah's reasonable security measures.
No Warranty as to Users
Humrah does not warrant or represent that:
- Any user's profile information is accurate, current, or complete.
- Any user's stated identity corresponds to their actual legal identity.
- Any user has undergone or passed any form of criminal background check or character screening. Humrah does not conduct such checks.
- Face verification confirms a user's identity beyond confirming that a real person recorded the verification video and that the same face has not previously registered an account on the platform.
- Any meetup facilitated through the platform will result in a positive, safe, or compatible experience.
Third-Party Links and Services
The Service may contain references or links to third-party websites or services. Humrah does not endorse, control, or accept responsibility for any third-party content, products, or services. Your interactions with third-party services are governed by those parties' own terms and policies.
16. Indemnification
You agree to indemnify, defend, and hold harmless Humrah, its officers, directors, employees, and agents from and against any claims, proceedings, damages, losses, liabilities, and reasonable costs (including legal fees) arising from or in connection with:
- Your breach of any provision of these Terms.
- Your violation of any applicable law or regulation.
- User Content you have submitted to the Service.
- Your conduct toward or interactions with other users, whether on the platform or offline.
- Any offline meeting you attend or arrange through the platform.
- Any third-party claim arising from your use of the Service.
Humrah reserves the right to assume control of the defence of any matter subject to indemnification by you, at its own cost. In that case, you agree to cooperate with Humrah's defence of such claims. Your indemnification obligation does not apply to the extent that the relevant claim arises directly from Humrah's own negligence or wilful misconduct.
17. Dispute Resolution & Arbitration
Step 1: Informal Resolution
Before initiating any formal legal process, you agree to attempt to resolve the dispute with Humrah informally. To do so, send a written description of the dispute, including your registered email address and the remedy sought, to legal@humrah.in with the subject line "Dispute Notice". Humrah will acknowledge receipt within 7 business days and attempt to resolve the matter within 30 days of receipt. If the dispute is not resolved within that period, either party may proceed to arbitration as described below.
Step 2: Binding Arbitration
If informal resolution fails, all disputes, claims, or controversies arising out of or in connection with these Terms or the Service — including disputes about the formation, validity, enforceability, or scope of this arbitration agreement — shall be finally resolved by binding arbitration under the Indian Arbitration and Conciliation Act, 1996, as amended. The following terms apply to arbitration:
- Seat of Arbitration: Delhi, India. The arbitration shall be conducted in Delhi unless the parties agree otherwise in writing.
- Language: The arbitration proceedings shall be conducted in English.
- Number of Arbitrators: A sole arbitrator, to be mutually agreed upon by the parties. If the parties cannot agree within 15 days of the dispute being referred to arbitration, the sole arbitrator shall be appointed in accordance with the Indian Arbitration and Conciliation Act, 1996.
- Procedure: The arbitrator shall apply Indian substantive law. The arbitration shall be conducted on a documents-only basis unless the arbitrator determines that an oral hearing is necessary.
- Award: The arbitrator's award shall be final and binding on both parties and may be enforced in any court of competent jurisdiction.
- Costs: Each party shall bear its own costs of arbitration unless the arbitrator determines otherwise based on the merits.
Small Claims Exception
Notwithstanding the above, either party may elect to bring an individual claim before a competent court of small causes or similar tribunal in Delhi, India, where the value of the claim falls within the monetary jurisdiction of such court and the claim qualifies for that forum. This exception does not apply to class actions or consolidated claims, which are prohibited under this section.
No Class Actions
You agree that all claims must be brought in your individual capacity only. You waive any right to bring or participate in any class action, collective action, or representative action against Humrah, to the extent permitted by applicable law.
Injunctive Relief
Nothing in this section prevents either party from seeking interim or injunctive relief from a competent court where necessary to preserve rights or prevent irreparable harm pending the outcome of arbitration.
18. Governing Law & Jurisdiction
Governing Law
These Terms and any dispute arising out of or in connection with them shall be governed by and construed in accordance with the laws of India, including but not limited to:
- The Indian Contract Act, 1872.

Jurisdiction
Subject to the arbitration provisions in Section 17, and to the extent that any matter is brought before a court, the courts of Delhi, India shall have exclusive jurisdiction to hear and determine that matter. You irrevocably submit to the jurisdiction of such courts for this purpose.
19. Changes to These Terms
Right to Amend
Humrah reserves the right to amend these Terms at any time. The "Last Updated" date at the top of this document will be revised upon each update.
Material Changes
Where proposed amendments are material — meaning they alter user rights, introduce new obligations, or change the liability or dispute resolution provisions — Humrah will provide advance notice through one or more of the following:
- An email notification to the user's registered email address.
- An in-app notification displayed on next login.
- Where required by applicable law, a request for fresh consent before the amendments take effect.
Material amendments will take effect no earlier than 15 days after notification, except where an earlier effective date is required by law.
Non-Material Changes
Corrections to language, formatting updates, or clarifications that do not alter the substance of a user's rights or obligations may be made without individual notification. Such changes take effect from the date of publication.
Continued Use
Continued use of the Service after the effective date of an amendment constitutes acceptance of the amended Terms. If you do not accept an amendment, you must stop using the Service and delete your account before the amendment takes effect.
Summary of Key Legal Revisions (For Internal Reference)
The following material legal deficiencies and risks were identified and corrected in this revised Terms of Service:
- Added a standalone Intermediary Status section (Section 2) explicitly defining Humrah as an intermediary under the IT Act, 2000, clarifying that Humrah does not employ, supervise, or act as agent for users, and that bookings are peer-to-peer.
- Removed the legally unsupported claim that face verification can assess or verify user age; replaced with a declaration-based age confirmation model consistent with the revised Privacy Policy.
- Rewrote the verification section to accurately describe what face verification does and does not guarantee, and added a verification appeal process with a 15-business-day response commitment.
- Added a dedicated Booking Nature section (Section 6) clarifying that Humrah is not a party to or agent for any booking arrangement, and that no employment, partnership, or agency relationship is created.
- Rewrote the offline meetings/safety section (Section 8) to legally establish assumption of risk, user autonomy, no duty of care for offline conduct, and no background verification representation — while avoiding aggressive or dismissive language.
- Added platform enforcement powers to Section 9, including content removal rights, temporary feature restrictions, investigation authority, evidence preservation rights, and law enforcement cooperation — without those powers implying supervisory liability.
- Rewrote the liability cap (Section 14) with a proportional formula (higher of amounts paid or ₹5,000), removed the unenforceable flat ₹10,000 cap, added an explicit statutory rights carve-out to avoid the clause being struck in its entirety, and separated exclusion categories by type.
- Repaired the arbitration clause (Section 17) to be enforceable under the Indian Arbitration and Conciliation Act, 1996, with specified seat (Delhi), language (English), appointment procedure, document-based procedure, and a small claims exception.
- Added a class action waiver and injunctive relief carve-out to the arbitration section.
- Rewrote the termination section (Section 13) to include risk-based suspension, shadow restriction ability, and evidence preservation powers — separately from standard data deletion timelines.
- Added survival clause to termination section, listing provisions that remain in effect after account closure.
- Ensured biometric data references, location data use, and moderation/investigation provisions are consistent with the consent-based processing described in the Privacy Policy.
- Removed marketing and emotional language throughout, including the closing tagline.
- Added a user content licence clause with clear scope limitations and ownership retention.
